Coupons distributed or circulated without the written approval of Abiker, for example on an Internet message board or on a “bargains” website, are not valid for use and may be refused or cancelled.

4.3 Permitted usage of Coupons

Unless expressly stated otherwise at the time of issue of the Coupon;
Each issued Coupon will be valid for use by a recipient only once,
Only one Coupon will be valid for use per customer or household, as the case may be, and,
A Coupon may not be used in conjunction with any other special offer or Coupon.
Coupons cannot be exchanged for cash or used to purchase gift-vouchers.

4.4 Excluded goods and services

Certain goods or services are excluded from all Coupon offers. From time to time other goods or services may be excluded and any such further exclusion will be notified to you along with the Coupon or through the www.bonnebouffe.co.uk website.
Coupons may be limited to redemption in respect of certain products or services or certain products or services may be excluded from the ambit of use of the Coupon, in which case notice will be given to you at the time of issue of the Coupon.
Excluded goods and services will not count towards any qualifying conditions for offers and will not benefit from any promotional discount.
Where an online offer states that a percentage discount will be given on a purchase, the cost of the qualifying purchases will be reduced by the stated discount percentage.

If we reasonably believe that any Coupon is being used unlawfully or illegally we may reject or cancel any Coupon and you agree that you will have no claim against us in respect of any rejection or cancellation. Abiker reserves the right to take any further action it deems appropriate in such instances.
If we refuse a Coupon submitted as part of an order, for any reason, we will inform you before the order is dispatched to advise of the correct cost of the order and give you the opportunity to cancel the order.

4.6 Limitation of liability

At all times our acceptance of an order takes place on dispatch of the order, at which point the purchase contract will be made and you will be charged for your order.
All offers are subject to availability and while stocks last.
Abiker shall not be liable to any customer or household for any financial loss arising out of the refusal, cancellation or withdrawal of any Coupon or any failure or inability of a customer or household to use an e-Coupon for any reason.

4.7 Miscellaneous

We reserve the right to vary or terminate the operation of any Coupon at any time without notice.
The failure of Abiker to take any action in respect of a breach of these terms and conditions shall not constitute a waiver of their enforceability. Abiker reserves its rights in respect of these terms and conditions at all times.
Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price. Your statutory rights are not affected.

5. Excluded Services

11. Prices

The price of the goods will be as quoted on the web site at the time you confirm your order (usually by clicking the “checkout” button) subject only to any inadvertent technical error for which we will not be liable.
If you subsequently amend your order to add items, the prices charged will be those applicable to the new item(s) at the time that the amended order is confirmed.
Where a substitute item is offered in place of an item ordered, the price charged for that substitute item (if accepted) will be the price applicable at the time the item is substituted
All prices are expressed inclusive of any VAT payable unless otherwise stated.
The price of the items does not include the Delivery charge which will be charged at the rates applicable. It will be displayed in the ‘Shipping Policy’ section of the web site.

12. Availability

If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you. Please note that we will attempt to deliver substitute lines, should selected lines be unavailable, unless you request us not to do so.
We may limit the quantities of goods (particularly goods on special offer) supplied to any one customer if in our opinion the quantity ordered jeopardises availability for other customers. For example, if you were to make an order of 10 Cases of water which would use up all of our stock, we may only deliver 5 Cases.

13. Acceptance

There will be no contract of any kind between you and us unless and until we actually dispatch the goods to you. Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and us, and you will be charged for the goods.

14. Delivery

Delivery will be made to the address specified by you on the completed order form.
Please note that we deliver goods only to specified regions within the United Kingdom . To check that the online Grocery service delivers to your area, please check on the shipping policy page.
Whilst we make every effort to deliver all your goods in the agreed time, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control.
Should you fail to be present for your delivery we are entitled to charge you in full for an amount equal to the price of perishable items contained in your order and the cost of delivery.

15. Returns of non-perishable items

We guarantee the quality of our goods. You must inspect the goods and notify us promptly in writing, by phoning our call centre or by an E-Mail.
We will promptly and fully refund the price of any goods that do not meet with your reasonable satisfaction or arrange for the delivery of replacement goods, provided that you notify us within 7 days of delivery of the goods.
We will arrange with you for the goods to be returned to us.
Your statutory rights are not affected.

16. Returns of perishable items

We do not accept the returns of perishable goods unless they are faulty. You must inspect the goods and notify us promptly in writing, by phoning our call centre or by an E-Mail.
We will promptly and fully refund the price of any faulty goods or arrange for the delivery of replacement goods, provided that you notify us within 7 days of delivery of the goods.
Your statutory rights are not affected.

17. Cancellation

You can cancel or change any of your current orders up until 5pm 2 working days before delivery. You can do this using the “Contact” page on the www.bonnebouffe.co.uk site, or emailing us at sales@abiker.co.uk

18. Payment

You can pay by any MasterCard or Visa credit card, Maestro or Delta debit card. Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure.
Authority for payment must be given at the time of placing your order.
Our liability to you in connection with any order will not exceed the total price charged for the relevant items.
We accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology. This means you cannot inadvertently place an order through an unsecured connection.

19. Privacy & Personal Data use

When you register with us, we will ask you to provide us with some personal information:
– Your email address. We will use it to send you confirmation of your order and we might use it in order to contact you about your order or your delivery.
– Your name and full address will be used to identify and locate you at the time of the delivery.
– Your telephone number and/or mobile phone number will be used to give you information about your delivery slot, your order or your delivery.

We will keep record of these information so you don’t need to re-enter them every time you want to place an order on this web site. We will also keep record of your purchases on our website which means that if you want to order the same goods, you can use one of your previous orders and do not have to re-enter each good.

If you wish to withdraw your personal information from our database, you can email web@abiker.co.uk and we will proceed to the removal. It does mean that you will not be able to place an order any more on our site unless you create un new user profile.

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.
If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

22. Miscellaneous

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
If you breach these Terms and Conditions and Abiker ignores this, Abiker will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
Abiker shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.
A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
